1. Who we are and what you are agreeing to
Athlete-X is a platform that connects athletes with their coaches, scouts, and sports organizations. These Terms of Service (the "Terms") govern your use of the athlete-x.io website, the web application at app.athlete-x.io, and the Athlete-X mobile app (together, the "Platform"), operated by Athlete-X Inc. ("Athlete-X", "we", "us").
By creating an account or using the Platform, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Platform. If you use the Platform on behalf of an organization, you confirm that you have the authority to bind that organization, and "you" includes the organization.
2. Eligibility and parental consent
You must be at least 13 years old to use the Platform. If an athlete is under 16, a parent or guardian must consent to their participation. During onboarding we collect a parent or guardian email address and send them a link to approve or decline. The parent or guardian can change that decision at any time using the same link.
A parent or guardian who consents for a minor, or creates an account with them, accepts these Terms on the minor's behalf and is responsible for the minor's use of the Platform.
3. Accounts
Provide accurate, current, and complete information when you create your account, and keep it up to date. You are responsible for keeping your credentials confidential and for the activity under your account. Two-factor authentication is available in your account settings, and we recommend enabling it. Tell us right away at support@athlete-x.io if you believe your account has been compromised.
Do not create an account for another person without their authorization, impersonate anyone, or use a name that violates someone else's rights.
4. Roles
Accounts hold one or more roles: athlete, coach, scout, or organization owner or admin. What each role can see and do is scoped by the Platform and described in section 5 of the Privacy Policy. You agree to use only the access your roles give you.
5. Your content
You keep ownership of everything you submit: profile details, portfolio content, documents, check-in responses, and messages. You grant Athlete-X a non-exclusive, worldwide, royalty-free license to host, display, and share that content as needed to operate the Platform, following your visibility settings and the role-based access described in the Privacy Policy.
You are responsible for what you submit. That includes having the right to share the contact details of other people you add to your portfolio, and linking only videos you have the right to share. We may remove content that violates these Terms or that we reasonably consider harmful.
If you share your portfolio through your share link, anyone with the link can view it, as described in the Privacy Policy. You can regenerate the link at any time.
6. Acceptable use
Do not use the Platform to:
- Post false, misleading, or fraudulent information.
- Harass, threaten, exploit, or harm anyone, or solicit personal information from minors.
- Scrape, crawl, or systematically collect data without our written permission.
- Attempt to access accounts or data your roles do not give you access to.
- Interfere with the operation or security of the Platform.
- Break any applicable law.
7. Coaches, scouts, and organizations
If you use the Platform as a coach, scout, or organization staff member, you agree to use athlete information only for coaching, athlete development, and legitimate talent evaluation within the Platform's purpose. In particular:
- Keep athlete check-in, injury, and Identity information confidential. Do not share it outside your organization without the athlete's explicit consent (and a parent's, where the athlete is a minor).
- Do not sell athlete data or use athlete contact information for unrelated communications.
- When contacting a minor, do so for legitimate recruitment or coaching purposes and involve the athlete's parent or guardian where appropriate or required.
Organization owners are responsible for their organization's subscription and for the conduct of the staff they invite.
8. Not medical or professional advice
Check-ins, the Identity test, and the Lab are informational and coaching-support tools. They are not medical, psychological, or therapeutic services, they make no diagnosis, and they are not a substitute for advice from qualified professionals. If an athlete may be injured or struggling, consult a qualified professional. In an emergency, contact local emergency services.
Lab answers and Identity summaries are generated by artificial intelligence. They can be incomplete or wrong. Coaches remain responsible for their own decisions.
9. Plans, billing, and cancellation
Payments are processed by Stripe. Current prices are always shown before you subscribe, at checkout.
Organizations
- An organization subscription is a plan plus a fee per member spot, billed monthly or yearly.
- A first subscription starts with a 30-day free trial. A payment card is required to start the trial, and billing begins when the trial ends unless you cancel before then. Trials apply to a first subscription only.
- Subscriptions renew automatically until cancelled.
- You can cancel at any time; access continues until the end of the paid period. Plan changes take effect immediately and are prorated.
- If the subscription ends or a payment fails and is not resolved, staff access is restricted until the subscription is reactivated.
- An organization can choose to sponsor its athletes' plans as part of its subscription.
Athletes
- The Starter tier is free and does not expire.
- The paid Athlete plan is billed monthly, with no trial, and renews automatically until cancelled. Cancelling stops renewal; access continues until the end of the paid period.
- If an organization sponsors your plan and that sponsorship ends, your paid features continue for a 7-day grace period before your account returns to Starter.
Amounts already paid are not refunded for partial periods, except where the law requires otherwise. We may change prices with advance notice; changes apply from your next renewal.
10. Availability
We may modify the Platform, and we may suspend it temporarily for maintenance or security. We do not guarantee uninterrupted or error-free service.
11. Intellectual property
The Platform's software, design, trademarks, and original content belong to Athlete-X or its licensors. These Terms give you no rights to them beyond using the Platform. The Athlete-X name and logo may not be used without our written consent. If you send us feedback or suggestions, we may use them without obligation to you.
12. Termination
We may suspend or terminate your account if you violate these Terms or use the Platform in a way that harms other users, us, or third parties. Where reasonable, we will warn you first.
You can delete your account at any time in the web app under Account settings, or by writing to support@athlete-x.io. If you own an organization, transfer its ownership or delete it first. Deletion of your data works as described in the Privacy Policy. Sections that by their nature survive (your content license for content already shared, disclaimers, limitation of liability, governing law) survive termination.
13. Disclaimer of warranties
The Platform is provided "as is" and "as available", without warranties of any kind, express or implied, to the extent the law allows this exclusion. Nothing in these Terms limits rights that mandatory consumer protection law gives you, including under Québec's Consumer Protection Act.
14. Limitation of liability
To the fullest extent permitted by applicable law, Athlete-X is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. To the same extent, our total liability for any claim is limited to the greater of the amounts you paid us in the 12 months before the claim and CAD $100. Some jurisdictions do not allow these limitations, so they may not apply to you.
15. Governing law
These Terms are governed by the laws of the Province of Québec and the federal laws of Canada that apply there. Disputes go to the courts sitting in Montréal, Québec, except where mandatory law gives you the right to another forum.
16. Language
These Terms and the Privacy Policy are available in French and English.
17. Changes to these Terms
When we change these Terms, we update the effective date at the top. For material changes we will tell you by email or with a notice on the Platform before the change takes effect. Continuing to use the Platform after a change means you accept the updated Terms.
